The following terms and conditions govern all use of the Garderobe.ae website and all content, services, and products available at or through the website. The Website is owned and operated by Garderobe. United Arab Emirates is Garderobe's country of domicile. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including Privacy Policy), and procedures that may be published from time to time on this Site by Garderobe (collectively, the “Agreement”).


Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the website, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. Garderobe considers these terms and conditions an offer and acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 18 years old.

Content Posted on Other Websites

We have not reviewed, and cannot review, all the material, including computer software, made available through the websites and webpages to which Garderobe.ae links, and that link to Garderobe.ae. Garderobe does not have any control over those non-Garderobe websites and webpages and is not responsible for their contents or their use. By linking to a non-Garderobe website or webpage, Garderobe does not represent or imply that it endorses such website or webpage. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Garderobe disclaims any responsibility for any harm resulting from your use of non- Garderobe websites and webpages.


Your Garderobe.ae Account and Site


If you create an account/profile on the Website, you are responsible for maintaining the security of your account and profile, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must not describe or assign keywords to your profile in a misleading or unlawful manner, including in a manner intended to trade on the name or reputation of others, and Garderobe may change or remove any description or keyword that it considers inappropriate or unlawful, or otherwise likely to cause Garderobe liability. You must immediately notify Garderobe of any unauthorized use of your account or any other breaches of security. Garderobe will not be liable for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions.
Every member can control a single account. If a member is discovered to have multi accounts, all accounts will be banned and deleted.


Responsibility of Account Holders


If you have an account and a profile, comment, or post material anywhere on the Website, post links on the Website, or otherwise make (or allow any third party to make) material available by means of the Website (any such material, “Content”), You are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of whether the Content in question constitutes text, graphics, an audio file, or computer software. By making Content available, you represent and warrant that:

  1. The downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party.
  2. If your employer has rights to intellectual property you create, you have either (i) received permission from your employer to post or make available the Content, including but not limited to any software, or (ii) secured from your employer a waiver as to all rights in or to the Content.
  3. The Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content.
  4. The Content is not spam, is not machine- or randomly generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third-party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing);
  5. The Content is not pornographic, does not contain threats or incite violence, and does not violate the privacy or publicity rights of any third party.
  6. The Content is not in violation of the United Arab Emirates local, federal, and cyber laws.
  7. Your profile is not getting advertised via unwanted electronic messages such as spam links on newsgroups, email lists, other blogs and web sites, and similar unsolicited promotional methods; and
  8. Your profile is not named in a manner that misleads your readers into thinking that you are another person or company. For example, your profile’s URL or name is not the name of a person other than yourself or company other than your own.

By submitting Content to Garderobe for inclusion on your profile, you grant Garderobe a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your profile. If you delete Content, Garderobe will use reasonable efforts to remove it from the Website, but you acknowledge that caching or references to the Content may not be made immediately unavailable.

Without limiting any of those representations or warranties, Garderobe has the right (though not the obligation) to, at Garderobe’s sole discretion (i) refuse or remove any content that, in Garderobe’s reasonable opinion, violates any Garderobe policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Website to any individual or entity for any reason. In this scenario, Garderobe will have no obligation to provide a refund of any amounts previously paid.

Electronic Communication

We accept payments via Visa and MasterCard credit/debit cards, Cash on Location (where available), and Bank transfers.

When you use the Site or send emails to Garderobe, you are communicating with Garderobe Dubai electronically. You consent to receive communications from Garderobe Dubai electronically. Garderobe Dubai will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

 

Responsibility of Website Visitors

Garderobe has not reviewed, and cannot review, all the material, including computer software, posted to the Website, and cannot, be responsible for that material’s content, use or effects. By operating the Website, Garderobe does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful, or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The Website may also contain material that violates the privacy or publicity rights or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying, or use of which is subject to additional terms and conditions, stated or unstated. Garderobe disclaims any responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted.

Note:

•   All international delivery times are subject to custom clearance.
•   Garderobe will NOT deal or provide any services or products to any of OFAC sanctions countries in accordance with the law of UAE. Regulations may prohibit importation of items made with exotic materials (e.g., crocodile skin) to certain countries.
•   Currently, we do not ship to Bonaire, Sint Eustatius and Saba, Iran, Pakistan, Iraq, Qatar, North Korea and South Korea.
•   Please note that these rates are subject to change without notice.
•   Our items are shipped from Dubai, UAE. Almost all countries apply custom duties on import of items. As mentioned above, the customer will be required to pay the customs duty upon delivery of the products.

  1. If an order is returned to us because a customer refuses to pay custom duties on delivery of the product. We will deduct the shipping charges and custom duties incurred as a result of the return from the final refund.
  2. Garderobe is not liable for any delays in deliveries due to custom clearances at destination. 
  3. Orders: Placing an order with Garderobe does not guarantee the item will be delivered - reasons could be due to errors with the systems. If items are ordered but are unavailable, a full refund will be issued to the customer.
  4. Garderobe reserves the right to cancel any orders we deem as incorrect, faulty or suspicious.

Currencies:

Items can be displayed on our store in other currencies using the currency converter. However please note that all orders are processed in UAE Dirhams (AED)

 

Discounts

  • We reserve the right to change or discount policies or cancel discounts at any time without prior notice.
  • Discount codes do not apply to blogger / influencer items. Special items may also be excluded from discount promotions.
  • Discount codes not redeemed at checkout will not be refunded or credited back to the customer. However, the customer may use the discount code on the next purchase provided the code is still valid (unexpired)

Installment Plans

Items above AED 1,000 can be purchased with an installment plan. Buyer will have to request and await confirmation from Garderobe if the item can be purchased with a plan. If agreed:

 

  1. Buyer will have to pay an upfront, non-refundable deposit which is 25% of the item value.
  2. Buyer will get 60 days to complete the purchase, or the Plan will be void. 
  3. In the event the payment is not completed on time, the installment plan will be cancelled.

Returns

Garderobe will not be accepting any clothing returns as we put the health of our employees and clients as top priority.

Please note that products bought with 'Cashew' or 'Tabby' are not eligible for returns, refunds, or exchanges.

All items sold are pre-loved by a third party, and the condition of each garment is clearly described on the website. If you receive your item and find it to be damaged or not as described, we are happy to offer you a credit note. 

Exchanges (if applicable)

We only replace items if they are defective or damaged.  If you need to exchange it for the same item, send us an email at customercare@garderobe.ae and send your item to: Villa 1224, Al Wasl Rd, Umm Suqeim 2, Dubai - UAE.

  

Discount Codes Terms and Conditions

  1. ALL discount codes apply to orders below 10,000 AED (Please note, this code is applicable for selected items only)
  2. Special items may be excluded from this promotion. Items that do not indicate discount eligibility clearly on the product page are excluded from this offer.
  3. Discount codes not redeemed upon checkout on the website are automatically forfeited.
  4. Garderobe reserves the right to cancel discounts deemed as erroneous or fraudulent.
  5. Only one discount code may be redeemed per order. Two discount codes cannot be applied to the same order.
  6. Free Shipping Promotions apply for First Time Customers Only. If you are a First Time Customer, you will receive the Free Shipping Code at the Checkout Page.
  7. Free Shipping promotions apply for only "standard shipping" rates. Express and heavy shipping rates are not included in this promotion.
  8. In the case of a return for an order shipped with the ‘Free Shipping’ Code, shipping charges will be applied to the refund. The shipping charge will be deducted from the total amount refunded to the client in such cases.

Consignment Terms & Conditions

 

1. Consignment

a. Consignment period:  


Each item is consigned for 4 months. The consignment period will officially begin from when the quotations offered are confirmed (in writing) and the items are listed on Garderobe’s system. It is also the consignor’s responsibility to keep track of when the items have expired.

 

b. Consignment of quotations offered: 

We request a confirmation message from consignors within 5 days once the quotation(s) are sent. If we do not receive response, we will consider the prices are accepted and confirmed and proceed to list them for sale on all platforms. Please note that all items cannot be listed for sale on our website and social media channels, our team selects which ones are listed on our platforms.

 

c. Condition of Items: 

Items will not be accepted for consignment if there are any stains, dirt, odours or faults in the item. Garderobe will not accept any items with defects and if received, the item(s) will have to be returned to the consignor – either collected from the store or delivered for AED 25. If the items consigned after confirming the price need to be repaired (i.e., sole repairs, re-stitching, leather cleaning, dry-cleaning, etc.) a fee will be charged to the consignor.

 

d. Dry-cleaning: 

Clothing consigned with Garderobe must be dry-cleaned and sent to the store with the original plastic cover from the dry cleaners before listing them for sale. The consignor must inspect the items before sending them to ensure there are no stains If the items need to be dry-cleaned on behalf of the consignor, we can carry out this service – however, there will be a 20% mark up on the cost of dry-cleaning. We will deduct this amount from the account balance once the items sell. If the clothing items consigned do not sell within the 3-month period, the dry-cleaning fee will have to be paid upon collecting the items.

 

2. Communication

a. Contacting Garderobe: 

Garderobe’s official method of communication is through emails. Please do note however, that we may contact you on WhatsApp in regard to pricing and giving you feedback on items you submit for Sale. If you do wish to be contacted via email only, please do specify so we can ensure all information is directed to the preferred channel of communication. Do ensure that all messages sent from Garderobe are checked as it is the consignor’s responsibility to do so.

 

b. Consignor account updates: 

We request consignors to follow up on the status of their accounts as we are not able to provide you with regular account updates. For payment related or account status related inquiries please email us at customerservice@garderobe.ae. Kindly send us a message there to receive an update on items that were sold and/or payment due dates.

 

3. Consignor Payments

a. Confirmation of sale: 

Garderobe agrees to pay proceeds from the sale of the consigned merchandise as initially agreed and communicated to you. Payments can be requested when the sale is finalized, and the item has passed the return period.

 

b. Payment date: 

Garderobe follows a 3 payment cycle every month. The payment dates will fall on 10th, 20th and 30th of the month. Items are only due for payment 40 days after they have sold. If the payment date falls on a weekend or a holiday, payments will be processed on the next business day, the timing of processing and delivering payments will vary but will typically take up to 4 business days for it to reach your account. If your bank account is an international account, it can take up to 7 business days.

 

c. Payment method: 

Garderobe only processes payments to consignors via bank transfers. Garderobe will issue cheques under exceptional circumstances to consignors. If a cheque does need to be issued, there will be an AED 25 fee deducted from the total amount. If the consignor wishes to receive their payment via a bank transfer, it is mandatory that the name of the account holder is the same as your original ID that you submit to us. Please find the bank detail form attached to this contract, this form needs to be filled out and submitted before any payments can be processed.

 

e. Request for payment:

Payments will only be processed when the consignor requests for payment. Kindly note that consignors need to send their bank details to customerservice@garderobe.ae in order to receive payments. Garderobe does not update consignors regularly on items sold and when payments can be received, please request these details by emailing us.

 

4. Discounts and reductions

a. Discounts: 

Please note that there will be automatic reductions each month on the original share we offer you, the structure will follow as below:

  • After 1 month:  10% reduction from your original share will be applied
  • After 2 months: 20% reduction from your original share will be applied
  • After 3 months: 30% reduction from your original share will be applied

Exceptions will be made on certain items including: classic Hermes and classic Chanel. (i.e. Hermes Kelly, Hermes Birkin, Chanel Classic Double/Single Flap Bag, Fine Jewellery and exotic leather bags)

 

b. Expired items and reductions: 

Garderobe will have items that have been in the store after the 3-month consignment period packed and ready for collection. If items are deemed fit to be consigned post the official consignment period, Garderobe will recommend reducing the prices. If the revised prices are not agreed upon, the items will be kept aside to be collected. Please note that if consignors have not agreed to prices set for the items or have expired, Garderobe will inform the customers that the items are ready for collection and the consignor will have 1 week to collect the items. Post the first week, there will be a fee of AED 25 per day for late collection.  If the items are not collected within 2 weeks, the items will be deemed fit as Garderobe’s property.

 

5. Installment plan

For items sold above AED 1,000, Garderobe offers the option for items to be purchased on an installment plan. For items purchased on an installment plan, the customer will have to pay an upfront, non-refundable 25% deposit and will have 3 months to complete the purchase of the item. Consignors, however, will only receive the payment once the item is sold.

 

6. Late collection and returns

Garderobe will charge a fee of AED 25 per day in the event that items are not collected a week from the date Garderobe and/or the consignor confirms that the item will be collected from the store (for returns, expired items, items that are not in acceptable conditions or items that have not been confirmed for sale). If the items are not collected within 2 weeks, the items will be deemed fit as Garderobe’s property. 

If items cannot be collected, Garderobe offers to deliver the items locally to the consignor’s address. The delivery will however be incurred by the consignor and the fee will vary based on the location.

 

7. Early collection fee

If the consignor decides to collect the item(s) before the 3-month consignment period expires, there is an AED 100 per item early collection fee. For classic Hermes bags and/or fine jewellery, the fee is AED 200 per item.

 

8. Authenticity fee

Garderobe will charge the consignor AED 200 per item, for items that are proven by our team to be inauthenticFurthermore, if an item is sold and a customer claims that the item is inauthentic, the consignor is expected to return the full amount that they were paid for.

 

9. Processing fee

It is noticeable that there might be an extra amount added over the selling price – this is a handling fee for services such as authentication, listing, dry-cleaning, etc. This fee is tacked on based on the selling price of the consigned item:

  • For items between AED 1 – AED 800: AED 100
  • For items between AED 800 – AED 10,000: AED 200
  • For items between AED 10,000 – AED 20,000: AED 400
  • For items above AED 20,000, 3% of the selling price will be tacked on

 

10. Disclaimer

When items are consigned, Garderobe has visual proof (images sent via WhatsApp when brought into the store or online submission images) to prove the condition of the items. If the consignor claims the item is damaged when its returned, we will need image proof and the damage and/or repair will be paid for. With that being said, all items consigned with Garderobe are handled with care. Please do however note that we allow customers to try on items displayed in-store. 

By consigning with us, you agree to our terms and conditions on how items are sold.  For more information, please refer to our terms and conditions on our website. 

T&C’s are subject to change with updates and these changes will take precedence over previous contracts signed. In the event of the above terms and conditions changing, Garderobe will inform consignors of any revision via email. Garderobe reserves the right to update its terms and conditions at any given time.


Counterfeit Items

For items that are not accepted after quality check, Garderobe will contact you to arrange a return. If Garderobe is unable to establish contact with you for 3 months, the item will be donated to charity.

In the case of inauthentic items, Garderobe will charge an authentication fee of AED 200 per item at the time of return.

Garderobe will not bear the charges nor arrangement for shipping back inauthentic or unsellable items.

 

Copyright Infringement

As Garderobe asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by Garderobe.ae violates your copyright, you are encouraged to notify Garderobe and Garderobe will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. Garderobe will terminate a visitor’s access to and use of the Website if, under appropriate circumstances, the visitor is determined to be a repeat infringer of the copyrights or other intellectual property rights of Garderobe or others. In the case of such termination, Garderobe will have no obligation to provide a refund of any amounts previously paid to Garderobe.

 

Intellectual Property

This Agreement does not transfer from Garderobe to you. Any Garderobe or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with Garderobe. Garderobe, Garderobe.ae, the Garderobe.ae logo, and all other trademarks, service marks, graphics and logos used in connection with Garderobe.ae, or the Website are trademarks or registered trademarks of Garderobe or Garderobe’s licensors. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any Garderobe or third-party trademarks.

 

Advertisements

Garderobe reserves the right to display advertisements on your profile.

 

Attribution

Garderobe reserves the right to display attribution links such as ‘Shop at Garderobe.ae,’ on your profile.

 

Changes

Garderobe reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Modifications will be effective from the day they are posted. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. Garderobe may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.

 

Termination

Garderobe may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your Garderobe.ae account (if you have one), you may simply discontinue using the Website, or delete your account (if you have one). All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

 

Disclaimer of Warranties

The Website is provided “as is”. Garderobe and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Garderobe nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.

 

Limitation of Liability

In no event will Garderobe, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; or (iii) for interruption of use or loss or corruption of data Garderobe shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

 

General Representation and Warranty

You represent and warrant that (i) your use of the Website will be in strict accordance with the Garderobe Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United Arab Emirates or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.

 

Indemnification

You agree to indemnify and hold harmless Garderobe, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.

 

Miscellaneous

In case of any disputes the law applicable would be based on the UAE Governing Law. 

Garderobe.ae will NOT deal or provide any services or products to any of OFAC sanctions countries in compliance with the law of UAE.”

This Agreement constitutes the entire agreement between Garderobe and you concerning the subject matter hereof, and it may only be modified by a written amendment signed by an authorized executive of Garderobe, or by the posting by Garderobe of a revised version.

 

VAT

VAT” means value added tax or any similar or substituted turnover or sales tax, imposed or administrated in the United Arab Emirates or elsewhere. 

Any consideration to be paid or given for taxable supplies made by Garderobe to the other party is to be treated as exclusive of VAT. The recipient of any such supply shall, in addition to the consideration for the supply or service, pay to Garderobe an amount equal to any VAT chargeable in respect of the supply in question on demand by Garderobe.

The Gulf Cooperation Council (GCC) of which the UAE and Kingdom of Saudi Arabia are member states along with Qatar, Kuwait, Bahrain, and Oman will have VAT implementation at a standard rate of 5%. From the 1 January 2018, businesses/ individuals in the United Arab Emirates (UAE) and Kingdom of Saudi Arabia (KSA) are required to comply with VAT rules and obligations. Charging of VAT, issuing tax invoices, filing periodical VAT returns and paying of VAT if any due to the tax authorities. Garderobe will comply to the rules and obligations for VAT set by the Governments of all jurisdictions we do business in and will calculate the VAT % as per what the Legislation specifies and the conditions that are to be met in order to apply the mechanism of sale of second-hand goods.

The payout as per agreement amount refers to the amount payable to you in respect of the goods and will be exclusive of VAT. Garderobe is not liable to pay the Seller and has the right to hold the payout(s) that may be due to the Seller’s non-compliance and defection as per the VAT Decree- Law applicable in the jurisdiction of business and shipping. Garderobe is not liable for any defect, non-compliance, non-payment that is limited or not limited to VAT and due on the Seller’s side for the items purchased by Garderobe.
